you can post bail once bail has been set. once posted, he will be out on bail until he violates the bail bond, violates the terms laid out by the court, gets sentenced, commits another crime or has his bail bond repealed by the bondsman or the courts.
Bond keeps him out until he has to go to jail/prison. He won’t necessarily go, but if he has plead and has agreed to serve time as part of the deal, then he will be sentenced on a future court date or be given a date to report to jail. Basically, your bond is keeping him out until his case is dismissed, he’s put on probation, or he actually starts to serve time. It’s hard to say for certain what is going to happen without knowing the charges, what the next court date is, etc., but once he goes to jail or is put on probation, you will be able to get your bond money back.
Will he pay you back for the money you post for his bail if the bail is forfeited?
If you post bail for your brother, he will be released until the court date unless he violates the conditions of his release, or commit another crime.
If he fails to show for trial you will loose the bail you posted. If he is found guilty, the court can order the amount of bail posted be applied to his fine, if any, and you will loose the bail money.
The court has the option of giving your brother both jail time and a fine. So he will only be out of jail until his trial.
First, if at all possible, post the entire bail with the court. That way it won’t cost you anything. The bail continues until he is sentenced, then is canceled. So the bail could be just for a short time.
Bail just means that he’s able to leave jail and be in the area until his court date. Its not an alternative to serving time.
If someone is arrested for something he can make a payment or give collateral to be outside of jail and when his court is over he gets the money back…if he jumps his court date he forfiets it and never gets the money back.
now if he’s sentenced to serve six months…he has to go to prison for six months. until his times up or he’s paroled or what not.
Posting bail is to make sure you have a reason to return to court for all court dates. If you go to them all, you get the money back. If you are convicted of the crime, the bail money can be returned or it might be applied to fines or restitution.
I would not post bail for anyone, even my brother, with my own money. If he doesn’t show up for court, the money is lost.
I would help my brother arrange bail using his money and a bail bondsman, but that’s it.
If you went through a bondsman,you pay 10% down to have hiim released.You are then responsible for payment of full bond amount which you usually pay before all cout date hearings and a sentence is given.Seems it works out that way.He is out on bond as long as you pay and he shows up .They never ever convict someone on 1st court date it can drag on for months,but hes still out till convicted.
